KAnalysis has been able to register a Trademark for “IBLINDS” on behalf of their client “Hab Home Intelligence LLC”, with notice on registration being issued on September 20, 2016.
The examiner had questioned regarding the class under which protection was being sought citing Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a). The key point of this objection was the use of motorized gadget that controls blind movement, owing to the objection of mark being registerable under class 20.
We had to provide many references showing registered marks wherein the sub-part has not taken into consideration in deciding the class of the Trademark. We meticulously collected such examples across classes and combinations to put across our point, which was duly accepted paving way for registration of the Trademark.
